Background:

The EU Pay Transparency Directive, is designed to enhance gender pay equity across EU member states by increasing transparency in pay practices. It requires companies with 100 or more employees to report gender pay gaps and, in cases where a gap of 5% or more is found, to conduct a pay audit. Furthermore, the proposal tightens the existing minimum criteria for sanctions in cases of noncompliance.

The directive also mandates that employers disclose pay ranges during recruitment and prohibits pay secrecy clauses. It shifts the burden of proof in pay discrimination cases, ensuring employers demonstrate non-discriminatory pay practices. These measures aim to promote fairness, accountability, and equal pay for equal work across the EU, ultimately supporting broader gender equality goals in the workplace.
